The Stichting Academy for Creative Leadership (hereinafter: the Academy) is a partnership between the International Center for Studies in Creativity at Buffalo State, State University of New York, located in Buffalo, New York, United States of America (hereinafter: ICSC) and the Center for Development of Creative Thinking, located in Antwerp, Belgium (hereinafter: COCD vzw).

The Academy is a foundation that aims to promote creative leadership in Europe. In this capacity it facilitates the ICSC’s graduate-level programs in Europe: the Graduate Certificate in Creativity and Change Leadership (hereinafter: Graduate Certificate Program) and a Master of Science Degree in Creative Studies (hereinafter: Master Program). These programs will be offered by the ICSC to a European cohort of students organized by the Academy through a combination of both seated and internet-based courses.

The Academy is registered in the Netherlands, Chamber of Commerce No. 63310511.
The Academy is located at Panamalaan 2E in Amsterdam.

 

Terms and Conditions

1.  General

1.1  By applying for ICSC’s Graduate Certificate Program offered through the Academy, you agree to the Terms and Conditions as described in this document. When you apply for ICSC’s Graduate Certificate Program, Sections 3 and 5 are not applicable. Furthermore, Buffalo State’s graduate school policies are in force (see also Section 4.5).
The course program, the course material, the education provided and the assessment and/or issue of a diploma falls under the accountability and responsibility of the ICSC. The Academy only facilitates the execution of an agreement between the student and the ICSC, so the student can follow the program in Europe.

1.2  By applying for ICSC’s Master Program offered through the Academy, you agree to the Terms and Conditions as described in this document. When you apply for ICSC’s Master Program, Sections 2 and 5 are not applicable. Furthermore, Buffalo State’s graduate school policies are in force (see also Section 4.5).
The course program, the course material, the education provided and the assessment and/or issue of a diploma falls under the accountability and responsibility of the ICSC. 1.3  By applying for workshops and events offered through the Academy, you agree to the Terms and Conditions as described in this document. When you apply for a workshop or event Sections 2, 3 and 4 are not applicable.

 

2.  ICSC’s Graduate Certificate Program – Application and Cancellation

2.1  A fully completed application package must be submitted within the prescribed period for the cohort to which you want to be admitted. The closing date for applications is published on this website and stated in the covering letter of the application package.

2.2  To have your application reviewed by the Buffalo State Graduate School and the Graduate Admissions Committee of the ICSC you must pay the non-refundable application fee of € 65.

2.3  A complete application does not guarantee admission, all applicants should be aware that admissions into graduate school are completely contingent on the qualifications of the applicant and the level of competition for available spaces for the incoming cohort of students. The Graduate School at Buffalo State reviews all applications and the Admissions Committee at the ICSC determines final admission.
The Academy is not involved in any way with the assessment of applications and excludes all liability in this matter.

2.4  A cohort in Europe will only start when there are sufficient students. This means there must be at least 14 admitted applicants. Furthermore, a cohort in Europe is limited to up to 24 students. When there are more qualified applicants, students will be admitted in the order of the date in which applications were received. If you cannot start the program based here in Europe in the year you prefer due to either case, you can request admission into the distance program based in Buffalo.

2.5  If you are qualified to pursue the Graduate Certificate program, you will receive a confirmation of admission. You will also receive a Graduate Admission Reply form for the next cohort that begins after your admission. By completing and submitting the Graduate Admission Reply form you accept the offer of graduate admission. By accepting this offer you agree with the Terms and Conditions described in this document and you commit yourself to paying the tuition of the Graduate Certificate Program after the 14 days reflection period.

2.6  Participation in the Graduate Certificate Program may be cancelled within 14 days of submitting the Graduate Admission Reply form. After this 14-day reflection period, you will receive a tuition bill and you are obliged to pay the full tuition of the Graduate Certificate Program within 14 days of the invoice date. Notice of cancellation must be received in writing by the Academy.
If you stop prematurely with the program and are not pursuing all courses, no refund of the tuition is given. There is also no refund of the tuition for the Graduate Certificate Program, if you are not admitted to the Master Program.

2.7  Tuition for the Graduate Certificate Program is subject to change, and is determined by Buffalo State. The amount due is the tuition as established by Buffalo State and published on this website in U.S. dollars.
The tuition will be collected in Euros and will be rounded to whole Euros. The applied exchange rate is based on the date your application is awarded and according to www.xe.com.

2.8  The tuition for the Graduate Certificate Program is exclusive of application costs. In addition to the non-refundable application fee, which you have to pay to the Academy, you will have other expenses for application, such as the TOEFL test, diploma transcripts and degree evaluation. The fee is determined by the organization you have or choose to consult.

2.9  The tuition for the Graduate Certificate Program is exclusive of travel and lodging expenses. During this program you will have to stay in the Netherlands for two weeks twice.

 

3.  ICSC’s Master Program – Application and Cancellation

3.1  A fully completed application form must be submitted within the prescribed period. The closing date for applications is stated in the covering letter of the application form.

3.2  You can only apply for the Master Program if you have pursued the Graduate Certificate Program and have earned the required 18 credit points or will have earned them by the start of the Master Program. Completion of the Graduate Certificate Program does not automatically result in admission to the Master Program. This is based on academic success and positive contributions to the learning environment in the program. Final admission decisions to the Master Program are made by the ICSC’s Admissions Committee.
The Academy is not involved in any way with the assessment of applications and excludes all liability in this matter.

 3.3  If you are qualified to pursue the Master Program, you will receive a confirmation of admission. You will also receive a Master Admission Reply form. By completing and submitting the Master Admission Reply form, you agree with the Terms and Conditions described in this document. By accepting the offer, you commit yourself to paying the tuition of the Master Program after the 14 days reflection period.

3.4  Participation in the Master Program may be cancelled within 14 days of submitting the Master Admission Reply form. After this 14 day reflection period, you will receive a tuition bill and you are obliged to pay the full tuition of the Master Program within 14 days of the invoice date.
Notice of cancellation must be received in writing by the Academy. If you stop prematurely with the program and are not pursuing all courses, no refund of the tuition is given.

3.5  Tuition for the Master Program is subject to change, and determined by Buffalo State. The amount due is the tuition in U.S. dollars as stated on the application form for the Master Program.
The tuition will be collected in Euros and will be rounded to whole Euros. The applied exchange rate is based on the date your application was awarded and according to www.xe.com.

3.6  The tuition for the Master Program is exclusive of travel and lodging expenses. During the program you will have one week of seated courses in the Netherlands for the final required class for the Master Program.
The Master Program requires elective courses as part of its curriculum. The costs associated with elective courses will depend on choices made by the student. You may have additional tuition, travel and lodging expenses. As an indication, you might take into account a trip to Sestri Levante, Italy for the CREA Conference and to Buffalo, New York, USA for the Creativity Expert Exchange.

3.7  If you would like to pursue a course at a non-U.S. university as an elective, you will need to prove that the level of the course is equivalent to the required U.S. level. This will involve costs for evaluation of the course level by an independent organization.
In addition, you will need to take care to transfer credit points toward your Master’s Degree for courses taken outside Buffalo State (except for proposed conference courses). Please, take also into account the costs and time needed to transfer your credit points. All transfer courses must adhere to Buffalo State policies regarding transfer credit points (see the Graduate Student Catalog available as a download from the Buffalo State Graduate School: http://catalog.buffalostate.edu/graduate).

 

4.  ICSC’s Graduate Certificate and Master Program – Further Conditions

4.1  Payment of the tuition is required within 14 days of the invoice date, and prior to participating.

4.2  Part of the study materials is supplied by the ICSC or the Academy. At the beginning of a course, all required materials are listed in the course contract. As an indication, we think it wise to set aside a budget of € 800 for books and other relevant study material.

4.3  The content of the curriculum for the graduate-level programs of the ICSC is the responsibility of the faculty. The Academy only facilitates the participation of the student in the program.

4.4  The application material and process for ICSC’s Graduate Certificate and Master Programs are consistent with all standard procedures and materials required by Buffalo State and the ICSC.

4.5  Buffalo State’s graduate school policies apply to all students in ICSC’s Graduate Certificate and Master Programs. Students are responsible for determining their academic programs and for meeting each degree requirement. Faculty or professional staff who serve as adviser is obligated only to assist students in meeting this responsibility. Clarification of any requirements for the degree may be obtained from the academic adviser or ICSC’s chair.

5.  Workshops and Events

5.1  A fully completed application form to attend a workshop or event must be submitted within the prescribed period.

5.2  Participation in a workshop or event may be canceled within 14 days of submitting your application form (reflection period). Notice of cancellation must be received in writing by the Academy.

5.3  Cancellation charges apply as follows:

i.  After the 14 days reflection period: € 50 administrative fee charged.
ii.  At least 21 days’ notice: 75% of the workshop/event fee.
iii. Less than 21 days’ notice: no refund given.

5.4  Payment of the fee in Euros is required within 14 days of the invoice date, and prior to participating.

5.5  Your participation in a workshop or event is assured once we have received the amount due. When there are more applications than seats, participants will be admitted in the order of the date in which the payment was received. The Academy reserves the right to refuse participation if the fee is not paid at the beginning of a workshop/event.

5.6  Postponing an enrollment to a later date is not possible.

5.7  The Academy reserves the right to cancel a workshop/event due to unforeseen circumstances, including but not limited to too few participants. In such cases, fees will be reimbursed. However, the Academy cannot accept responsibility for any travel, accommodation or other costs incurred for a cancelled workshop/event.

5.8  Reimbursement of fees will be paid within 21 days after the cancellation date.

5.9  Unless stated otherwise, all workshop materials are supplied by the Academy and are included in the fee.

 

6.  Confidentiality

6.1  The Academy, ICSC’s faculty members, students and participants commit themselves to retain the confidentiality of any confidential information. Information is confidential if it is designated as such by the other party or if this arises from the nature of the information.

6.2  Confidentiality is not applicable when the publication is necessary in connection to the execution of the agreement with the student/participant. In this case, the Academy is not liable for any compensation.

6.3  With regard to the privacy of the student/participant, the Dutch Law on the Protection of Personal Information (Wet bescherming persoonsgegevens – Wbp) is applicable, as well as any regulations based on this law. The Academy will process any personal information that is provided in relation to the agreement solely for the execution of the agreement and this personal information will not be provided to third parties.

6.4  Insofar as the Academy is legally obligated to publish this information, the Academy will strive in as far as is reasonably possible to impose confidentiality on third parties.

6.5  The Academy is not bound to indemnification or compensation for damage, if the Academy has to provide confidential information to third parties by law or by a court order.

 

7.  Intellectual Property

7.1  All intellectual property rights (including, but not limited to copyright, design rights and/or patent rights) on the documents provided by the Academy to the participant, such as reports, advice, agreements, designs, sketches, drawings, software, materials, lesson plans, training modules, training materials etc., rest with the Academy.

7.2  Any documents provided by the Academy, such as reports, designs, methods, models, advice, drawings and software can only be used by the participant. Provided documents shall not be made public, be reproduced, exploited or disclosed to third parties without the prior written consent of the Academy, unless otherwise arises from the nature of the documents.

7.3  The Academy reserves the right to make photos, and video and audio recordings during the courses and workshops for promotional activities. In case of objection, you need to notify the Academy in writing prior to participation.

 

8.  Force Majeure
The Academy is not bound to fulfilling any obligation if it is limited in doing so because of circumstances not attributable to its fault, and that do not, according to law, any legal act or the reasonable standards of society fall under its responsibility. For the purposes of these Terms and Conditions, force majeure encompasses, in addition to everything determined on this matter in law and case law, all exterior causes, foreseeable or not, that are beyond the influence of the Academy, but which leads to the Academy not being able to fulfill its obligations.

 

9.  Complaints
In case of complaints about the service provided to a student or participant by the Academy, please refer to the applicable complaints procedure. A complaint must be lodged within 10 weeks from the moment the situation occurred that gave rise to the complaint.

 

10.  Disclaimer
While the Academy endeavors to ensure that the information on our website is correct, we do not provide any warranties for the accuracy and completeness of the material on our website, nor on ICSC’s and Buffalo State’s website or in any corporate brochures. We may make changes to the material on the site or to the products and prices described on it at any time without notice.

 

11.1  Applicable Law

11.1  This agreement is exclusively subject to Dutch law.

11.2  Any disputes between the Academy and the student/participant fall under the exclusive jurisdiction of the courts for the Midden-Nederland region, located in Utrecht (The Netherlands).

 

12.  Location and Changes of the Terms and Conditions

12.1  The Academy always declares the most recent version of the Terms and Conditions applicable.

12.2  These Terms and Conditions will always be provided prior to any agreement between the Academy and the student/participant and are in full included on this website.
